Welcome to Kixi. These Terms of Service govern your use of our website and your purchase of products from us.

In these Terms, “Kixi”, “we”, “us” and “our” mean Kixi (Pty) Ltd, of Shop B59, Oriental City, Rooihuiskraal, Centurion, 0157**. “You” means a visitor to our website or a customer who places an order with us.

By using this website or placing an order, you agree to these Terms.

## 1. Products and availability

Kixi sells footwear and related products through this website.

We aim to display product descriptions, images, colours, sizes and prices accurately. However, colours may appear differently depending on your screen, and minor variations may occur.

All products are subject to availability. Adding an item to your cart does not reserve it. If an item becomes unavailable after you place an order, we will contact you and offer a refund, replacement, or another reasonable solution.

## 2. Orders and acceptance

When you place an order, you make an offer to buy the selected products at the displayed price.

Your order is accepted only when we send you an order-confirmation email. We may need to decline or cancel an order where there is a genuine pricing or product-description error, suspected fraud, unavailable stock, or another lawful reason. If we cancel a paid order, we will refund the amount paid for the unavailable or cancelled item.

Please ensure that your contact, delivery and billing details are complete and accurate.

## 3. Prices and payment

Prices are displayed in South African rand (ZAR) and include VAT where applicable, unless we clearly state otherwise.

Delivery charges, if applicable, are shown at checkout before you complete payment.

Payment must be made through the payment methods available at checkout. We do not store your full card details. Payment processing is handled by our approved payment providers.

## 4. Delivery

We currently deliver within South Africa only.

Our delivery terms, charges, dispatch times and estimated delivery windows are set out in our Shipping Policy, which forms part of these Terms. Delivery dates are estimates, not guarantees.

You are responsible for providing a correct and accessible delivery address. If delivery is delayed or unsuccessful because the address or contact details are incorrect, we will work with you to arrange redelivery where possible. Additional reasonable delivery costs may apply.

Risk in the products passes to you when the products are delivered to you or to a person authorised by you to receive them. Ownership passes once we have received full payment.

## 5. Returns, refunds and consumer rights

Our Returns Policy explains how to request a return, exchange or refund.

Nothing in these Terms limits or excludes any right you may have under applicable South African law, including the Consumer Protection Act and the Electronic Communications and Transactions Act.

If a product is faulty, unsafe, does not match its description, or otherwise fails to meet the applicable legal standard, please contact us promptly at info@kixi.co.za. We will assess the matter and provide the remedy required by law.

For hygiene and product-care reasons, returned footwear must be clean and returned with its original packaging, unless the return relates to a fault, defect, incorrect item or another situation where applicable law provides otherwise.

## 6. Customer-uploaded content

Where our website allows you to upload photographs, images, artwork, text, designs or other content (“User Content”), you confirm that:

- you own the User Content or have all necessary rights, permissions and licences to upload it and to authorise Kixi to use it for your order;
- the User Content does not infringe another person’s copyright, trademark, privacy, publicity or other legal rights;
- the User Content is not unlawful, offensive, defamatory, harmful or misleading.

You retain ownership of your User Content. Kixi does not claim copyright or ownership in any images or other content you upload.

By uploading User Content, you grant Kixi a limited, non-exclusive, royalty-free licence to reproduce, adapt and use it solely to process, produce, fulfil and deliver your order.

You are responsible for the User Content you upload. To the fullest extent permitted by law, Kixi is not responsible for copyright or other intellectual-property claims arising from User Content uploaded by you where you did not have the necessary rights or permissions.

You agree to indemnify Kixi against reasonable losses, claims or costs arising directly from your breach of this section.

We may refuse, remove or decline to process User Content that we reasonably believe may infringe rights, violate these Terms, or be inappropriate.

## 7. Promotions and discount codes

Promotions, discount codes and special offers are subject to their stated terms, availability and expiry date. Unless we state otherwise, they cannot be combined, exchanged for cash, or applied retrospectively to completed orders.

We may withdraw or correct a promotion where there is a genuine error, provided we do so lawfully and fairly.

## 8. Website use

You may use this website for lawful personal and non-commercial purposes only.

You must not:

- use the website in a way that is unlawful, fraudulent or harmful;
- interfere with the website’s security or operation;
- attempt to gain unauthorised access to systems, accounts or information;
- copy, reproduce, distribute or commercially use website content without our prior written permission.

## 9. Kixi intellectual property

The Kixi name, logos, product designs, photographs, videos, text, graphics and website content belong to Kixi or its licensors and are protected by applicable intellectual-property laws.

This does not include User Content uploaded by customers. No right or licence is granted to use Kixi’s intellectual property except as necessary to use this website for its intended purpose.

## 10. Privacy

We process personal information in accordance with our Privacy Policy and applicable data-protection law, including the Protection of Personal Information Act.

By placing an order, you authorise us to use your information as reasonably necessary to process payment, fulfil and deliver your order, provide customer support, prevent fraud, and meet legal obligations.

## 11. Third-party services

This website may use or link to third-party services, including Shopify, payment providers, delivery partners and social-media platforms. Their services are subject to their own terms and privacy policies. We are not responsible for third-party websites or services outside our reasonable control.

## 12. Liability

We take reasonable care to provide accurate information and a functioning website. However, to the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from your use of this website or a product purchase.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability relating to consumer rights, unsafe or defective goods, fraud, or wilful misconduct.

## 13. Changes to these Terms

We may update these Terms from time to time. The version published on this website applies from its effective date. Changes will not retrospectively affect orders that we have already accepted, unless required by law or agreed with you.

## 14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa.

If you have a concern, please contact us first at  info@kixi.co.za and allow us a reasonable opportunity to resolve it. Nothing in this clause prevents you from using any consumer-protection remedy or dispute-resolution process available to you under applicable law.
